1.1 Welcome! You've reached www.apartment128.com (the "website"), a space we've created just for you. We are Apartment 128 LLC, a company registered in Ohio.
 
1.2 If you're here for personal, non-commercial purposes, then when we say "you" in these Terms & Conditions (the "Terms"), we're talking directly to you. You're part of our community now, and we're thrilled to have you here.
 
1.3 These Terms, along with our Privacy Policy, are like our house rules—they give you all the details about us, the legal terms and conditions under which we sell our products to you. Together, they form the "Agreement".
 
1.4 By setting up an account and ordering a product through this website, you're saying "yes" to a contract with us under these Terms. Those who set up an account become part of our "User" family. Even if you don't create an account but use our site, you're agreeing to abide by these Terms each time you visit us.
 
1.5 If you're not comfortable with these Terms, we understand. However, it would mean you can't use this website.

2. Placing an Order

 

2.1 Here's how a contract for the purchase of a product is created:

2.1.1 To place an order, you'll need to become a User by creating an account, as outlined in Section 1.4;

2.1.2 Once you're a User, you can place an order on our site by pressing the order confirmation button at the end of the checkout process;

2.1.3 By confirming your order, you're saying "yes, I want to purchase this product";

2.1.4 At this stage, we'll process payment for your order using your preferred payment method;

2.1.5 We'll acknowledge receipt of your order and confirm our acceptance by sending you an "order confirmation email", making the agreement legally binding between both of us. Each order placed will incorporate these Terms and will be a new and separate contract between you and us;

2.1.6 Once your order has been dispatch ed for shipping, we'll send you a "shipping confirmation email".

 

2.2 If for some reason we can't fulfill your order, we'll get in touch to let you know and refund your payment. We might reject an order due to:

2.2.1 Your chosen product not being in stock;

2.2.2 Unable to obtain authorization for your payment;

2.2.3 A significant pricing or product description error;

2.2.4 Your order breaching any of these Terms;

2.2.5 We suspect that the order has been placed fraudulently;

 

 

3. Presenting our Products & Pricing

 

3.1 We strive to present each product on our website as authentically as possible. However, just like in life, slight variations in color, and typefaces. Rest assured, these small differences are part of what makes our products unique and special.

 

3.2 Please note that while we aim to provide stable prices, they are subject to change. We reserve the right to adjust them as necessary.

 

3.3 Every so often, a price displayed for a product might be incorrect—oops! If this happens, we'll do our best to correct it swiftly, and we'll let you know the accurate price before you make your payment. If there's an obvious and unmistakable pricing error, we're not obliged to provide the product at the incorrect price, even after an order confirmation email has been sent.

 

3.4 All prices shown on our website are in USD. The price of the product does not include shipping charges or sales tax. You'll see these additional costs at checkout. For more details on shipping, please refer to Section 4.

 

3.5 Just a heads up - Apartment 128 doesn't cover any additional customs or import charges, duties, or taxes that might come up when the parcel reaches its destination country. If you're concerned about potential import taxes when your order ships from the US, we recommend checking with your government's import office.

 

 

4. Delivery of Products

 

4.1 The cost of shipping is shown separately from the cost of goods when you check out—no surprise fees here.

4.3 We'll provide an estimated shipping date when you place your order. Just keep in mind that sometimes, things beyond our control might affect shipping (for more details, see Section 13). Remember, the dates and times we give for shipping are estimates—we do our best, but we can't be held responsible for any delays.

 

4.4 Just a reminder—our brand doesn't cover any additional customs or import charges, duties, or taxes that might come up when the parcel reaches its destination country. If you're concerned about potential import taxes when your order ships from the US, it's a good idea to check with your government's import office.

 

 

5. Our Refund Policy

 

5.1 We want you to be thrilled with every single product you receive from us. However, if your products arrive damaged or with a printing error, we're here to make it right. You can request a refund or a replacement according to clause 5.2 below.

 

5.2 If you spot a printing fault or damage to your order, please let us know within 7 days of receiving the product(s). Just drop us an email at support@apartment128.com with your order number and a clear photo and description of the issue, and we'll see if you're eligible for a refund or replacement.

 

5.3 Opting for a refund? No problem. We'll refund the total amount you paid for the product(s)—including any shipping charges—within 28 days of the day you show us evidence of the faulty order.

 

5.4 If you'd prefer to have your product(s) replaced, we'll happily do so free of charge and send them back to you without any additional costs.

 

5.5 Please note, while we're all about options, we don't offer both a refund and a replacement. It's either one or the other.

 

5.6 If you decide to return an item, we'll refund the total amount you paid for the product(s), plus any shipping charges, within 28 days of receiving the return. For more details, please refer to Section 6.

 

 

6. Our Returns Policy

 

6.1 We wholeheartedly want you to love your purchase. If, however, your product(s) arrive damaged or with a printing error, we're here for you. You can request a refund or a replacement—just check out Section 5 for all the details.

 

6.2 To arrange a free return, head over to our returns page on site or drop us a line at support@apartment128.com. Once we receive your return, we'll issue a full refund for the product within 14 days. Just make sure the item is returned in its original condition and packaging—we're sure you understand.

 

6.3 A little note: Our returns policy outlined above deals with change-of-mind instances and doesn't affect the statutory rights you have as a consumer. These include the right to cancel, the right to return items that are faulty or not as described, and a general right to return most online purchases under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

 

 

7. Payments & Charges

 

7.1 At Apartment128, we're all about making things easy for you. That's why we accept payment through the methods listed in the payment section during checkout on apartment128.com.

 

7.2 When it comes to charges, transparency is our motto. The total costs for your chosen products and shipping are clearly displayed on the checkout page and also included in your order confirmation email.

 

7.3 We'll deduct the payment from your account when we send you the order confirmation email. It's just like a digital "sold" sign on your items!

 

7.4 By placing an order, you're assuring us that all the details you've provided are valid and accurate at the time of order. And when your order is accepted by us, payment will be made in full. It's all part of our trust-based relationship.

 

7.5 If for some reason we can't accept your order (see Section 2.2 for more details), don't worry—no charges will be made to your card. Because we believe in fair play.

8.2 Intellectual Property Rights

8.4 We love that you admire our work, but we ask that you don't copy, distribute, create derivative works from, or commercially exploit the content from Papier or any materials found on our website without our express, written permission first. It's about respecting the hard work and creativity that goes into everything we do.

10.1.1 Any loss of income or revenue, business, profits or contracts, and anticipated savings. After all, we're here to inspire your home decor dreams, not manage your financial portfolio.

10.1.2 Any loss or corruption of data. While we strive to create a safe digital environment, we recommend you also take steps to protect your personal data.

10.1.3 Any loss or damage which does not directly result from our failure to comply with this Agreement. We're committed to upholding our end of the deal, but we can't take responsibility for things outside of our control.

 

 

11. Ownership & Responsibility

 

11.1 We pour all our love and effort into creating these products for you, but once they leave our hands and arrive at your doorstep, they're all yours - with all the joys and responsibilities that come with it. So, from the moment of delivery, any risk associated with the product is transferred to you.

 

11.2 Just like the best things in life, ownership doesn't happen overnight. It's a journey. For our products, this journey ends when we receive full payment for all sums due, including those shipping charges. Once that's settled, the product is all yours. However, we must reserve the right to end this Agreement immediately if its terms are breached, or if due payments are not made. 13. Circumstances Beyond our Control

 

13.1 Our promise is to always strive for excellence in delivering our products to you. However, there are times when circumstances beyond our control may cause a delay or failure in production or shipping. Please understand that we, or any shipping and production service we utilize, cannot be held responsible for these unforeseen events.

 

13.2 When we mention "Circumstances Beyond Our Control," we're referring to any situation that's out of our hands. This could range from severe weather conditions like snowstorms, floods, or hurricanes, to strikes, civil unrest, war threats, fires, earthquakes, epidemics, or other natural disasters. Even road traffic accidents and closures fall under this category. These are all unpredictable events that, unfortunately, can impact our ability to fulfill our commitments.
